Seller Agreement


 
This agreement binds sellers to the terms and conditions mandated by liquidationtime.  Through these policies, LiquidationTime governs your use of the Liquidationtime site to post items for sale.  All sellers must agree to these terms in order to utilize the LiquidationTime site and services.

Accepting these terms binds you to the Agreement of liquidationtime's Terms of Use and Privacy Policy and all other terms and conditions posted on the LiquidationTime site. The terms of this Business Exchange Seller Agreement are  Marketplace Seller Agreement are additives to the liquidationtime.com Terms of Use and Privacy Policy. By clicking below to enter this Business Exchange Seller Agreement, you also confirm your agreement to abide by the Terms and conditions of LiquidationTime.com.

Seller Qualifications:
You must be 18 years or older to use the Liquidationtime site and services.  You must legally be capable of lawfully entering into and forming contracts under the relevant law.  All information provided to liquidationtime must be real and valid.  Any information such as your name, current address, phone number, and/or email address must be accurate and existent.  By agreeing to these terms, you authorize LiquidationTime to verify the accuracy of your information via the necessary procedures including a credit or background check as well as other required measures.  LiquidationTime has the right to deny or terminate a sellers’ account for any reason it may wish to do so.

 When sellers make a sale through liquidationtime, buyers are purchasing these products directly from the sellers via liquidationtime and not from the liquidationtime company.  Liquidationtime has no control over the consistency of the buyers and cannot guarantee that buyers will complete the transaction.    Liquidationtime has no control over the ability of buyers to pay for items they purchase from you.   By becoming a member on the LiquidationTime site, you agree and warrant that your use of liquidationtime will comply with the relevant laws and regulations.  

At any time, LiquidationTime may terminate this Seller Agreement and may halt any pending listings or sales at any time without notice to you.  LiquidationTime has the right to set transaction restrictions on any seller and will not be legally responsible to any seller for halting or otherwise refusing to complete any transaction. Liquidationtime.com also reserves the right to withhold the payment of funds to you or to return funds to the buyer if we are currently investigating any claim or any suspected or alleged wrongful conduct by you or any violation of this Seller Agreement, and you agree that liquidationtime.com will not be liable to you for any such amounts. If a termination or suspension of your account should take place, liquidationtime.com reserves the right to hold all Seller Payments for 90 days to allow for Guarantee Claims and for the resolution of all amounts owed to liquidationtime.com.

Sellers will hold full and single responsibility for the precision, wholeness, and legitimacy of all the
information posted in their auctions for sale. Sellers posting Items for sale on (LiquidationTime.com) correspond to and affirm that they are the legitimate owners of the items which they list. Each seller assumes full responsibility for all aspects of their product listings including product descriptions, identification of quantities, and any additional information the seller uses in the auction to sell his or her products.

Sellers have to agree that LiquidationTime.com, at its single caution, can act with full rights and legality that it has judged to be necessary.  LiquidationTime may at any time review, edit or remove any listing information provided by sellers which may not comply with our rules and regulations. LiquidationTime reserves the right, to immediately halt any auction or product sale, prevent or restrict access to the site or services and take any other action in case of technical problems, objectionable material, inaccurate listings, inappropriately categorized items, auction inaccuracies, product inaccuracies, unlawful items, items, procedures, or actions otherwise prohibited by the procedures and guidelines contained on the Site and to correct any inaccurate listing, auction
inaccuracies, product inaccuracies, inappropriately categorized items or technical problems on the site or for any other reason in the sole and absolute discretion of LiquidationTime, it is felt that a buyer, seller, LiquidationTime.com or someone else may be injured or adversely affected by the postings, auction, etc.

Merchandise MUST be available for pickup within a time limit of 3-5 business days after the auction has closed. If after the auction closes, the merchandise is not available for pick-up within 3-5 business days, the seller is responsible for any and all penalties and/or damages. There are NO EXCEPTIONS.  Merchants who do not meet Liquidation Time’s service standards will not be permitted to list items on the site.

Merchants providing false, inaccurate, or misleading information on their postings, selling fraudulent, counterfeit or stolen items, infringing on any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy, or violating any laws, statutes, or ordinances will be banned from LiquidationTime.com.

 You agree to reply punctually and consistently to inquiries by LiquidationTime.  In the event that liquidationtime supplies any amount to a buyer in association with a buyer's claim or the buyer requests a chargeback with the buyer's credit card company, you agree to promptly reimburse liquidationtime.com for the amount of the transaction and other/any fees and charges in connection with the transaction, including any associated shipping charges as well as seller’s 5% fee.  Liquidationtime.com may immediately compensate any such amount from any other amount to
be paid to you in accordance with this Business Exchange Seller Agreement, may charge your credit card on file, and/or may collect such funds in any other lawful method. Without limiting any of its rights to rectification, if liquidationtime.com concludes that you have directly or indirectly attempted or committed fraudulent activity with respect to the Business and/or Business Guarantee Claim process, liquidationtime.com may immediately suspend or terminate your account, withhold your Seller Payments, and/or offset any such amount from any other amount to be paid to you in compliance with this Business Seller Agreement, charge your credit card on file, and/or collect such funds in any other lawful manner to recover any damages and costs incurred by liquidationtime.com in association with such dishonest activity. In addition, any such fraudulent activity is a criminal offense and violators will be prosecuted to the fullest extent of the law.

By submitting material to LiquidationTime.com the seller agrees to be held solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission and agrees to pay for all legal fees, expenses and other cost incurred by LiquidationTime.com to defend or otherwise handle allegations dealing with issues of this nature.We will not knowingly allow the use of our platform to sell illegal items of any kind through LiquidationTime.com, including, without limitation to stolen or misrepresented merchandise, counterfeit goods, drugs, firearms, knock-off merchandise, pornographic material, multi-level marketing products or any other items of questionable nature that in the opinion of this company is unlawful.
 
Upon posting belongings for sale, the seller represents, warrants, and agrees that it is once and for all offering to sell the listed belongings to any qualified Buyer who meets the requirements of the auction’s terms for payment and shipping. Sellers agree to ship to the highest bidder. Sellers must represent and warrant that he has legal title to the offered belongings, and that those items are free of any lien, security interest, leasehold interest, and/or co-ownership interest. Sellers warrant that he/she has not listed belongings to take over rights, privileges, or activities that belong to somebody else or violates (by all or by part), any third party's copyright, patent, trademark, trade secret or
other intellectual property or proprietary rights.

Seller agrees to pay LiquidationTime a fee of 5% of the final auction price. This fee will be deducted from the proceeds of the sale prior to the seller receiving payment.  You agree to reply punctually and consistently to inquiries by LiquidationTime.  In the event that liquidationtime supplies any amount to a buyer in association with a buyer's claim or the buyer requests a chargeback with the buyer's credit card company, you agree to promptly reimburse liquidationtime.com for the amount of the transaction and other/any fees and charges in connection with the transaction, including any associated shipping charges as well as seller’s 5% fee.  Liquidationtime.com may immediately compensate any such amount from any other amount to
be paid to you in accordance with this Business Exchange Seller Agreement, may charge your credit card on file, and/or may collect such funds in any other lawful method. Without limiting any of its rights to rectification, if liquidationtime.com concludes that you have directly or indirectly attempted or committed fraudulent activity with respect to the Business and/or Business Guarantee Claim process, liquidationtime.com may immediately suspend or terminate your account, withhold your Seller Payments, and/or offset any such amount from any other amount to be paid to you in compliance with this Business Seller Agreement, charge your credit card on file, and/or collect such funds in any other lawful manner to recover any damages and costs incurred by liquidationtime.com in association with such dishonest activity. In addition, any such fraudulent activity is a criminal offense and violators will be prosecuted to the fullest extent of the law.

This Site and Services may only be used for lawful purposes and in a lawful manner. You must agree to comply with all applicable laws, statutes, and regulations regarding use of the services, including, but not limited to bidding and purchasing of items.
